The purpose of these general conditions is to regulate the scope of the intermediation and organization service provided by VILLAS HOLIDAYS COSTABLANCA, S.L. (hereinafter “Villas Holidays”), domiciled at C/ San Juan, 34, Benissa (Alicante), in the rental of holiday accommodation agreed between the client and the accommodation provider.
Guest is understood as the natural or legal person who requests the professional intervention of Villas Holidays to locate a holiday accommodation for the use or enjoyment of the client according to the needs of the latter.
By lessor we mean the person who owns the accommodation object of commercialization by Villas Holidays through its intermediation services.
The signing of the contract implies the acceptance of each and every one of these conditions regardless of the contracting channel through which the reservation was made: Villas Holidays reservation telephone center, the Villas Holidays website or through call centers. reservations or external websites of other Agencies or tour operators with which Villas Holidays has collaboration agreements.
Additionally, contracting one of our villas implies acceptance of the particular conditions that apply to the contracted villa, which are specified in the Reservation Contract sent to the guest.
The rental prices are indicated per accommodation per day and per week. They are variable depending on the chosen week. The prices are clearly detailed on the website www.villaholidayscostablanca.com. In July and August, the minimum stay is 7 nights, with check-in and check-out on Saturdays. To enter and/or leave on other days, contact Villas Holidays to see possibilities. The rest of the year you can enter any day of the week and the minimum number of nights will be between 3 or 4.
For long-term reservations, ask for price and availability.
In all reservations, the prices include the set-up of the house, the maintenance and periodic cleaning of the pool and gardens.
Extra expenses such as final cleaning, sheets and towels, animals, air conditioning, heating, high chair and cot for babies, extra bed, extra cleaning and/or change of sheets and towels, will be reflected in the rental contract.
Additionally, contracting one of our villas implies acceptance of the particular conditions that apply to the contracted villa, which are specified in the Reservation Contract sent to the guest.
The form of payment may be through:
- To confirm the reservation, an advance payment of 50% of the total must be made on the day of the reservation.
- If after 5 days the payment has not been made, Villas Holidays will cancel the reservation.
- The final payment of 50% will be made 14 days before the collection of the keys.
The guest can cancel the reservation free of charge up to 14 days before the day of entry.
The refund will be made by credit card or transfer.
A subsequent cancellation would not be entitled to a refund of the payment paid.
The collection of the keys will take place, in high season, on Saturdays from 4:00 p.m. to 7:00 p.m.; and the rest of the year, from Monday to Friday from 4:00 p.m. to 6:00 p.m. The pick-up point is at the Villas Holidays office located at Partida Benimarco, 3, Benissa (Alicante). The Google Maps coordinates to get to the office are: 38.697245, 0.086066.
In case of arrival outside the pick-up hours, the guest can choose between two options:
Departures will be made before 10:00 in the morning and the keys will be delivered to the Villas Holidays office. If the office is not open on departure, the keys will be deposited in the key box, located inside the office parking lot. If the departure time is not met, without prior consent, it will incur a charge of €100 of the deposit.
The guest must leave the house tidy, without garbage and in the same conditions as it was found. Villas Holidays may carry out an inspection and charge €80 from the guest's deposit if it finds:
If during the inspection, Villas Holidays finds any lack in the content of the house or any damage caused by the guest, the guarantee deposit will be deducted. If the cost of the damage exceeds the amount of the guarantee deposit, the guest will be notified by phone or email. In case of not reaching an understanding in this regard, the corresponding legal actions will be taken.
In short-stay contracts, a guarantee deposit of €300 is established in houses with up to 7 people and €500 in houses with more than 7 people per reservation. This deposit will be withheld on the guest's credit card on the day of arrival, although it will not be effectively debited from your account unless there is litigation. The deposit will be automatically unlocked between a week and a month later, depending on the type of card, provided that no damage has been caused to the home.
In long-term contracts (more than 2 months), a guarantee deposit of at least one month's rent is established. This deposit will be returned once the stay in the house is over, discounting the utility bills that remain pending. The deposit will be held until said invoices are in the possession of Villas Holidays. Failure to comply with the exit conditions and conditions of use will lead to the loss of the guarantee deposit.
Villas Holidays reserves the right to modify or cancel a reservation due to serious circumstances. Serious circumstances shall be understood as those circumstances that are of such a nature that it is not considered reasonable to demand compliance with the contract from the accommodation provider. In case of force majeure, war, strikes and natural disasters, Villas Holidays may cancel the reservation. In such a case, it is obliged to return the amounts already paid. In order to ensure quality, Villas Holidays reserves the right to substitute rented accommodation for similar accommodation.
Villas Holidays reserves the right to replace the reserved accommodation with another of similar characteristics in the event of a serious unforeseen event that prevents the client from enjoying the stay in the planned accommodation.
Villas Holidays carries out preventive and corrective inspections in rental homes to avoid incidents during the guests' stay. Villas Holidays appreciates that guests indicate any incident or suggestion during their stay, even if it does not affect them directly, it can always help improve Villas Holidays services.
If you notice an error or deficiencies at the destination, the guest is expected to notify Villas Holidays, in order to avoid inconveniences. When serious complaints arise on site, the guest must immediately notify Villas Holidays. In this way, Villas Holidays has the opportunity to resolve the guest's complaint as soon as possible. If it is not resolved on site, Villas Holidays will have 48 hours to solve any problem that may arise. If you change to another accommodation or leave the rented accommodation early without consulting Villas Holidays, you will lose all rights of restitution.
a.- Responsibilities of the signing guest. The guest who reserves a home for himself and for other guests, will be jointly and severally liable for the total price of the rental and for the damages caused by his conduct and by that of all the others who remain lodged with him in the rented dwelling.
b.- Max guests. The reservation will be valid for the maximum number of people indicated in the reservation contract. The accommodation of more people than those indicated will not be allowed and the occupation with a higher number of people could lead to the termination of the rental contract and the loss of the deposit. In this case, the payments made will not be refunded and the guest must pay the total amount of the rent. If the guest intends to accommodate more people than allowed in the rented property, they should check with Villas Holidays if it is allowed and the extra cost.
c.- Animals. Not all houses accept animals. The guest is obliged to check with Villas Holidays if the house accepts animals. The extra cost per animal is €50 per week.
If it is verified that the guest has introduced an animal in the rented house that does not allow animals, Villas Holidays is authorized to proceed with the automatic cancellation of the stay, and the guest must leave the villa in a maximum of 8 hours since the owners of the housing do not authorize it. If animals are detected in a home that does allow animals to enter, but the guest did not notify them, they will not have to leave the rented home, but they will have to pay three times the established cost, with a minimum of €150, as a penalty for non-compliance.
d.- Celebrations or parties: Parties and celebrations are not accepted in any of our rental villas. In the case of holding a party or celebration despite its prohibition, there will be a charge on the deposit of at least €150, not including any damage that may be caused.
In the event that the guest wants to hold a celebration, we recommend that they indicate this to Villas Holidays in advance to see if there is a villa that could be adjusted to the celebration. In any case, it would only be possible if the client obtains the authorization of Villas Holidays in writing, after paying the extra cost and the corresponding deposit.
e.- Access to the property: During the stay, the house is for the exclusive use of the guests. However, guests must allow access to Villas Holidays employees or authorized personnel during their stay to clean the pool and garden, as well as to proceed with the repair or action derived from any incident that occurred in the property during their stay. . Villas Holidays staff will knock on the door of the house at least twice before entering the house and will only use the key when there is no response from the guest.
f.- Energy: Villas Holidays will specify, depending on the date of the reservation, a rate for heating or air conditioning expenses. This rate is established on the basis of an established maximum consumption. Said excess would be debited on the customer's card to cover the compensation to be made to the homeowner for it. The guest is recommended to make responsible and reasonable use of the electricity in the house to avoid an additional cost during their stay.
g.- House keys: The guest will be provided with a complete set of house keys. Additional sets of keys will not be provided, unless agreed with the reservations team. In the event that the guest does not return or loses the keys provided, €100 will be deducted from the guarantee deposit, for the expenses and inconvenience caused to Villas Holidays and the next guest.
h.- Additional extras: Villas Holidays offers the guest various rental accessories, such as: extra bed, cots, high chairs, car rental, experiences, etc. The guest can consult with the reservations team the wide range of possibilities, availability and prices.
i.- Final cleaning, bed linen and towels: On the website you can check if the costs of cleaning, bed linen and towels are included in the corresponding accommodation. If not, the corresponding expenses are indicated. These expenses are indicated together with the rental amount on the reservation form.
Villas Holidays is responsible for ensuring that the description of the houses corresponds to the general characteristics of the same, except for transcription errors, although the guest accepts that there may be some specific change in the content of the same as a result of the use of the same such as electrical appliances, exterior and interior furniture or decorative elements that are renewed periodically.
Villas Holidays is not responsible for possible modifications that affect the house or its surroundings that are not directly controllable by Villas Holidays. Specifically, the guest will not be able to claim any penalty if there is any of the following anomalies, provided that they have not been foreseen by Villas Holidays:
1.- Internet/Wifi: It is only available if it is expressly indicated in the description of the accommodation. Internet connection via WIFI is a service offered by the company free of charge for actions that consume a not very high amount of data. This service has not been taken into account to set the price of the reservation, so it will not be possible to claim due to speed problems or lack of connection.
Villas Holidays makes no guarantees for its continued availability, speed, compatibility or security. In general, Internet/Wifi is intended for holiday purposes, that is, it is not suitable for commercial or similar use. Any excessive discharge will mean the router will stop working. If the guest needs more information, it can be contracted at an extra cost. Consult the reservations department.
2.- Satellite/Cable Television: If satellite or cable television is indicated in the description, this does not automatically mean that you will be able to receive all the programs you want. Homeowners, mostly foreigners, have decoders that are not always capable of capturing all international programs.
3.- Water and electricity: There may be occasional cuts in water and electricity supply, due to the increase in inhabitants in the area, especially in high season. In no case can Villas Holidays or the owner of the house be held responsible for the inconveniences or damages caused by said limitations.
4.- Works: The accommodations are generally private properties of different individual owners and are generally located in large residential areas. Accommodations are not usually found in resorts, so unexpected construction work may incidentally take place in the vicinity. These works are usually carried out by owners, building contractors or government organizations with whom Villas Holidays has no relationship and therefore we have no influence on these actions. Neither the Accommodation Provider, nor the Booking Agent, nor the Lessor therefore assume any responsibility for the inconvenience caused by the works that are not carried out on behalf of the Accommodation Provider.
5.- Accident and theft: Neither Villas Holidays nor the owner of the accommodation is responsible for any loss or damage (injury, illness, death, material damage or theft) suffered by the guest or their companions during their stay. When making the reservation, the guest assumes responsibility for his personal safety and that of his belongings and exempts Villas Holidays and the owner of the property from any responsibility for them. To minimize the potential risks, special prevention is requested in the use of the kitchen as well as the swimming pool, since they are areas of the house with additional risks for the guest, as well as making sure that all the doors and windows of the property are closed correctly. These indications are especially recommended in the event that guests include children and the elderly.
Unlike the legal rules on the jurisdiction of the civil judge, any controversy between the supplier and the contracting party or the client will be submitted exclusively to the competent judge of the country or region where the Lessor is established or is a resident. After the Lessor has invoked this provision in writing, the Lessee may choose for one month to submit the dispute to the competent civil judge in accordance with the law or the applicable international treaty. The Lessor may consider the address indicated by the Lessee to be correct, unless otherwise stated. Any contract between the Landlord and the Tenant will be governed by International Law.
