GENERAL CONDITIONS

1. INTRODUCTION

The purpose of these general conditions is to regulate the scope of the intermediation and organization service provided by VILLAS HOLIDAYS COSTABLANCA, SL (hereinafter “Villas Holidays”), with address at C/ San Juan, 34, Benissa (Alicante), in the rental of holiday accommodation that is arranged between the client and the accommodation provider.

A guest is understood to be the natural or legal person who requests the professional intervention of Villas Holidays to locate a holiday accommodation for the use or enjoyment of the client according to the latter's needs.

The landlord is understood to be the person who owns the accommodation, which is marketed by Villas Holidays through its brokerage services.

The signing of the contract implies the acceptance of each and every one of these conditions, regardless of the contracting channel through which the reservation was made: Villas Holidays reservation telephone center, the Villas Holidays website or through centers of reservations or external websites of other Agencies or tour operators with which Villas Holidays has collaboration agreements.

Additionally, hiring one of our villas implies acceptance of the particular conditions that apply to the contracted villa, which are specified in the Reservation Contract sent to the guest after payment of the reservation.

2.- PRICES

The rental prices indicated are variable depending on the week chosen. The prices are clearly detailed on the website  www.villaholidayscostablanca.com . In July and August, the minimum stay is 7 nights, with check-in and check-out on Saturdays. To enter and/or leave on other days, contact Villas Holidays to check availability. The rest of the year you can enter any day of the week, with a minimum of between 2 and 4 nights depending on the selected home.

For long-term reservations, contact Villas Holidays to find out price and availability.

In all reservations, prices include the set-up of the house, the maintenance and periodic cleaning of the pool and gardens.

Extra expenses such as final cleaning, sheets and towels, pets, air conditioning, heating, high chair and cot for babies, extra bed, extra cleaning and/or change of sheets and towels, will be reflected in the rental contract.

3.- METHOD OF PAYMENT

The form of payment may be through:

  • Credit card (Visa or Mastercard). 
  • Wire transfer.
  • Cash (From July 11, 2021, operations with an amount equal to or greater than €1,000 cannot be paid in cash)

Neither stubs nor vacation checks will be accepted as a form of payment.

  • To confirm the reservation, an advance payment of 50% of the total must be made on the day of the reservation.
  • If after 5 days the payment has not been made, Villas Holidays will cancel the reservation.
  • The final payment of 50% will be made 14 days before the collection of keys.

4.- CANCELLATION CONDITIONS

In case of cancellation, the management company will refund 100% of the amount paid as long as the cancellation is made at least 14 days in advance .

The refund will be made by card and/or transfer according to the original payment method.

A subsequent cancellation would not be entitled to a refund of the amount.

5.- ENTRY AND KEY COLLECTION

Key collection will take place, in high season, on Saturdays from 4:00 p.m. to 7:00 p.m.; and the rest of the year, from Monday to Friday from 4:00 p.m. to 6:00 p.m. and Saturday. 

The collection point is at the Villas Holidays office located at Partida Benimarco, 3, Benissa (Alicante).

In case of arriving outside the pick-up hours , the guest can choose between two options:

  • Option 1 :   The guest will find the keys and the information to get to the house at any time in a safe located outside our office. The client has the obligation to check-in online. This option will be free of charge. 
  • Option 2 :  Our staff will deliver the keys to the guest for a supplement of €50, as long as Option 1 cannot be chosen. Maximum period of this service, from 4:00 p.m. to 10:00 p.m. Subject to availability and confirmation by Villas Holidays Costablanca.

6.- DEPARTURE AND RETURN OF THE KEYS

Departures will take place until 10:00 am and the keys will be delivered to the Villas Holidays office. If the office is not open upon departure, the keys will be deposited in a mailbox for the keys located inside the office car park (Photo included below). If the departure time is not complied with, without prior consent, it will entail a charge of €100 of the deposit. 

The guest must leave the house tidy, without garbage and in the same conditions as it was found. Villas Holidays could carry out an inspection and charge €80 of the guest's deposit in case it finds:

  • Furniture and utensils out of their original place.
  • Garbage inside or at the entrance of the property.
  • Uncleaned crockery, cutlery and kitchen utensils.

If during the inspection, Villas Holidays finds any fault in the content of the house or any damage caused by the guest, it will be deducted from the guarantee deposit. If the cost of the damage is greater than the amount of the guarantee deposit, the guest will be notified by phone or email. In case of not reaching an understanding in this regard, the corresponding legal actions will be taken.

7.- GUARANTEE DEPOSIT

In short-stay contracts, a guarantee deposit of €300 per reservation is established in houses of up to 7 people and €500 in houses of more than 7 people. This deposit will be retained on the guest's card on the day of arrival, and will not be debited from his account except in dispute. The deposit will be released automatically between a week and a month later, depending on the type of card, provided that no damage has been caused to the home.

In long-term contracts (more than 2 months) a guarantee deposit of at least one month's rent is established. This deposit will be returned once the stay in the home has ended, discounting the utility bills that remain pending and any damage caused by the tenant. The deposit will be retained until said invoices are in the possession of Villas Holidays. Failure to comply with the departure conditions and conditions of use will lead to the loss of the guarantee deposit.

8.- MODIFICATION OR CHANGE OF HOUSE

Villas Holidays reserves the right to modify or cancel a reservation due to serious circumstances. Serious circumstances shall be understood to be those circumstances that are of such a nature that it is not considered reasonable to require the accommodation provider to comply with the contract. 

In case of force majeure, war, strikes and natural disasters, Villas Holidays may cancel the reservation. In this case, it is obliged to return the amounts already paid. 

In order to ensure quality, Villas Holidays reserves the right to replace the rented accommodation with similar accommodation.

9.- SUGGESTIONS AND COMPLAINTS

Villas Holidays carries out prevention and improvement inspections in rental homes in order to avoid incidents for the subsequent stay of guests. Villas Holidays appreciates that guests indicate any incident or suggestion during their stay, even if it does not directly affect them, it can help improve services.

If you notice an error or deficiencies at the destination, the guest is expected to notify Villas Holidays within a maximum of 24 hours, in order to avoid inconveniences or undue charges.

When serious complaints arise on site, the guest must communicate them immediately, in this way, Villas Holidays has the opportunity to resolve the guest's complaint as soon as possible. If it is not resolved on site, Villas Holidays will have 48 hours to solve any problem that may arise. 

If you change to another accommodation or leave the rented accommodation early without consulting Villas Holidays, you will lose all rights.

10.- TERMS OF USE

a.- Responsibilities of the signing guest.  The guest who reserves a home for himself and other guests, will be jointly and severally liable for the total rental price and for the damages caused by his conduct and by that of all the others who stay with him in the rented home.

b.- Maximum number of guests. The reservation will be valid for the maximum number of people indicated in the reservation contract. The accommodation of more people than indicated will not be allowed. If the occupation with a higher number of people is breached, it could lead to the termination of the rental contract and the loss of the deposit. In this case, the payments made will not be refunded and the guest will have to pay the total amount of the rent. If the guest intends to accommodate more people than allowed in the rented home, they should check with Villas Holidays if it is allowed and its extra cost.

c.- Animals.  Not all homes accept animals. The guest has the obligation to check with Villas Holidays in advance if animals are accepted in the house. The extra cost per animal is €50 per week.

If, after entering the house, it is verified that the guest has brought an animal into the rented home that does not allow animals, Villas Holidays is authorized to proceed to the automatic cancellation of the stay, and the guest must leave the villa within a maximum of 8 hours. . If animals are detected in a home that does allow the entry of animals, but the guest did not notify them in advance, they will not have to leave the rented home, but they will have to pay a penalty for non-compliance of three times the established cost, with a minimum of €150.

d.- Celebrations or parties: Parties or celebrations  are not accepted in any of our villas or rental apartments. In the case of holding a party or celebration despite its prohibition, it will entail a charge on the deposit of at least €150, not including any damage that may be caused.

In the event that the guest wants to hold a celebration, they must consult Villas Holidays in advance to see if there is a villa that could accommodate the celebration. In any case, it would only be possible if the client obtains written authorization from Villas Holidays, upon payment of the extra cost and the corresponding deposit.

e.- Access to the property:  During the stay, the house is for the exclusive use of the guests. However, guests must allow access to Villas Holidays employees or authorized personnel during their stay to clean the pool and garden, as well as to proceed with the repair or action derived from any incident that occurred in the property during their stay. . The Villas Holidays staff will knock on the door of the house on at least two occasions prior to entering the house and will only use the key when there is no response from the guest.

f.- Energy:  Villas Holidays will specify, depending on the date of the reservation, a rate for heating or air conditioning expenses. This rate is established on the basis of an established maximum consumption. Said excess would be debited from the client's card to face the compensation to be made to the owner of the house. The guest is recommended to make responsible and reasonable use of the electricity in the house to avoid an additional cost during their stay.

g.- House keys:  The guest will be provided with a complete set of house keys. Additional sets of keys will not be provided, except as agreed with the reservations team. In the event that the guest does not return or loses the keys provided, €100 will be deducted from the guarantee deposit, for the expenses and inconvenience caused to Villas Holidays and the next guest.

h.- Additional extras:  Villas Holidays offers guests various rental accessories, such as: extra bed, cots, high chairs, car rental, experiences, etc. The guest will be able to consult with the reservations team the wide range of possibilities, availability and prices.

i.- Final cleaning, bed linen and towels:  On the website you can check if the cleaning costs, bed linen and towels are included in the corresponding accommodation. Otherwise, the corresponding expenses are indicated. These expenses are indicated together with the rental amount on the reservation form. 

11.- RESPONSIBILITIES AND BENEFITS

Villas Holidays is responsible for ensuring that the description of the properties corresponds to its general characteristics, except for transcription errors, although the guest accepts that there may be some specific change in its content as a result of the use of the such as household appliances, outdoor and indoor furniture or decorative elements that are renewed periodically.

Villas Holidays is not responsible for possible modifications that affect the home or its surroundings that are not directly controllable by Villas Holidays. Specifically, the guest may not claim any penalty if any of the following anomalies exist, provided they have not been foreseen by Villas Holidays:

1.- Internet/Wifi : It is only available if it is expressly indicated in the description of the accommodation. The Internet connection via WIFI is a service offered by the company free of charge for actions that consume not a very high amount of data. This service has not been taken into account to set the price of the reservation, so it will not be possible to claim due to speed problems or lack of connection.

Villas Holidays does not assume any guarantee for its continuous availability, its speed, its compatibility or its security. In general, Internet/Wifi is intended for vacation purposes, that is, it is not suitable for commercial or similar use. Any excessive discharge will mean that the router will stop working. If the guest needs more information, it can be contracted with an extra cost. Check with the reservations department.

2.- Satellite/cable television:  If satellite or cable television is indicated in the description, this does not automatically mean that you will be able to receive all the programs you want. Homeowners, mostly foreigners, have decoders that are not always capable of capturing all international programmes.

If in any case, the guest decodes the TV, it will imply a deduction of a part of the guarantee deposit.

3.- Water and electricity:  There may be occasional cuts or pressure failures in the water and electricity supply, due to the increase in inhabitants in the area, especially in high season. In no case can Villas Holidays or the owner of the property be held responsible for the inconvenience or damage caused by said limitations.

4.- Works:  The accommodations are generally private properties of different individual owners and are generally located in large residential areas. The accommodations are not usually found in tourist complexes, so incidentally it can happen that unexpected constructions take place in the surroundings. These works are usually carried out by owners, building contractors or government organizations with whom Villas Holidays has no relationship and therefore we have no influence on these actions. Neither the Accommodation Provider, nor the Reservation Agent, nor the Landlord therefore assume any responsibility for inconvenience caused by works that are not carried out on behalf of the Accommodation Provider.

5.- Accident and theft: Neither Villas Holidays nor the owner of the accommodation are responsible for any damage or loss (injury, illness, death, material damage or theft) suffered by the guest or their companions during their stay. When making the reservation, the guest assumes responsibility for his personal safety and that of his belongings and exempts Villas Holidays and the owner of the property from any responsibility for them. To minimize potential risks, special prevention is requested in the use of the kitchen as well as the pool, since they are areas of the house with additional risks for the guest, as well as making sure that all the doors and windows of the property are closed correctly. .

6.- Claim for insects: Villas Holidays will not be responsible for possible insects that may be found in the rented property, for which reason no compensation will be granted.

7.- Sheets and towels: Villas Holidays will provide sheets and towels in the rented house for the capacity of the house, unless otherwise agreed with Villas Holidays at the time of booking. It is your responsibility to use and care for them, otherwise, you may be penalized with a part of the guarantee deposit.

8.- Pool: Bathing with sun cream is prohibited, it is your responsibility to use the shower before using it to remove the remains of the sun cream. If you find traces of sun cream in the pool, Villas Holidays may charge an amount between €50 and €150 for its exhaustive cleaning.

9.- Air conditioning: In the event that the home has air conditioning, it is prohibited to turn on the air conditioning when guests are not in the home. Villas Holidays reserves the right to deduct disproportionate consumption from the guarantee deposit.

12.- CHOICE OF JURISDICTION AND APPLICABLE LAW

Unlike the legal regulations on the jurisdiction of the civil court, any dispute between the provider and the contracting party or the client will be submitted exclusively to the competent court of the country or region where the Lessor is established or is a resident. After the Landlord has invoked this provision in writing, the Tenant may choose for one month to submit the controversy to the competent civil judge in accordance with the law or the applicable international treaty. The Landlord may consider the address indicated by the Tenant to be correct, unless otherwise notified. Any contract between the Landlord and the Tenant will be governed by International Law.

13. –DATA PROTECTION

In compliance with the protection of personal data, the data collected from the guest will be incorporated into a file whose owner "VILLAS HOLIDAYS COSTABLANCA, SL" with CIF B42547125, and with fiscal address at C/ San Juan, 34, Benissa ( Alicante). That the treatment finds its legal basis in the consent given by the guest when signing this contract, and consequently, the guest accepts that the collection of the same has the following purposes: to provide the service object of the contract; allow communication between the parties; that you can exercise the rights of: access, rectification, deletion, limitation, portability, opposition, to file a claim with a control authority, and withdraw consent at any time, by letter, attaching a photocopy of your NIF/NIE/Passport to the postal address indicated above; that will be kept as long as the relationship between the parties is maintained or during the years necessary to comply with legal obligations.
